The bill amends Section 19 of P.L.2003, c.280 (C.45:14-58) to clarify the transmission of prescriptions for controlled dangerous substances. It allows practitioners to transmit prescriptions to pharmacists via telephone or electronic means, provided they include their Drug Enforcement Administration registration number and license number. However, prescriptions for Schedule II controlled substances must still be transmitted in writing and signed by the practitioner, unless they comply with federal and state regulations. Additionally, the bill mandates that vendors of electronic health records systems ensure their systems meet federal requirements for transmitting Schedule II prescriptions within one year of the bill's effective date, with an exception for telemedicine organizations.
Furthermore, the bill permits the transfer of Schedule II controlled substances prescribed for attention-deficit/hyperactivity disorder from one pharmacist to another, as long as the transfer complies with federal regulations. This act will take effect 60 days after its enactment.
