Additionally, the bill clarifies that these delivery restrictions do not apply to employees of the United States Postal Service performing their official duties.

The bill also amends existing laws to include new language that reinforces the age restriction and outlines the penalties for violations. Specifically, it introduces civil penalties for those who deliver or sell tobacco products or electronic smoking devices to individuals under 21, with escalating fines for repeated offenses. Furthermore, it allows for defenses against prosecution if the purchaser or recipient falsely represented their age or appeared to be of legal age. The Department of Health is authorized to adopt necessary regulations to implement the provisions of this act, which will take effect 180 days after its enactment.
