This bill mandates that employers in New Jersey must transparently announce and disclose promotional opportunities and compensation details in job postings. Specifically, employers are required to make reasonable efforts to inform current employees about internal and external promotional opportunities before making a promotion decision. However, promotions based on years of experience or performance are exempt from this notification requirement. Additionally, employers must include the hourly wage or salary, or a range thereof, along with a listing of benefits and compensation programs available to employees within their first 12 months of employment in all job postings. Each failure to comply with these requirements will be considered a separate violation.

The bill also outlines penalties for non-compliance, with fines escalating from $1,000 for the first violation to $10,000 for subsequent violations, enforceable by the Commissioner of Labor and Workforce Development. Temporary help service firms and consulting firms are exempt from disclosing wage and benefit information in job postings aimed at identifying qualified applicants for future openings but must provide this information during the interview or hiring process for specific job openings. The act is set to take effect seven months after its enactment.
