This bill establishes statewide targets for reducing the disposal of organic waste in landfills, aiming for a 50% reduction by January 1, 2027, and a 75% reduction by January 1, 2032, based on 2016 levels. The Department of Environmental Protection (DEP) is mandated to adopt regulations within 18 months of the bill's enactment to achieve these targets. These regulations may require local governments to impose requirements on organic waste generators and allow for reasonable penalties for noncompliance. Importantly, the regulations will not set a numeric organic waste disposal limit for individual landfills.

Additionally, local governments are permitted to charge fees to recover costs associated with compliance with the new regulations. By July 1, 2027, the DEP must submit a report to the Governor and the Legislature detailing the progress made in meeting the organic waste reduction targets, including an analysis of the effectiveness of the regulations and the status of organic waste recycling infrastructure in the state. The bill also clarifies that local governments retain the authority to implement stricter requirements regarding organic waste reduction than those established by the state.
