This bill establishes regulations regarding the use of social care information within a Closed-Loop Referral System (CLRS). It defines key terms such as "Closed-Loop Referral System," "participating organization," "social care," and "social care information," outlining the roles of various entities involved in the sharing and management of social care data. The bill emphasizes that social care information, which pertains to an individual's social needs and related services, must be handled with care and confidentiality.
Under the provisions of the bill, participating organizations are prohibited from selling or licensing social care information stored in or transmitted through a CLRS. Additionally, such information can only be used for the specific purposes for which it was collected. Violations of these regulations will result in a civil penalty of $1,000 for each infraction, which will be enforced by the Division of Consumer Affairs. The bill also mandates the Director of the Division of Consumer Affairs to adopt necessary rules and regulations for its implementation, with an effective date set for 180 days after enactment.
