This bill amends current law to allow county prosecutors in New Jersey to receive service credit in the Prosecutors Part of the Public Employees Retirement System (PERS) for their previous work as judicial law clerks. Specifically, it permits county prosecutors, who are nominated and appointed under the New Jersey Constitution, to purchase credit for their service as law clerks to judges of the New Jersey Superior Court or justices of the New Jersey Supreme Court. This service credit will be established in the Prosecutors Part without any additional cost to the prosecutor, provided the purchase is made after their appointment as a county prosecutor.
The bill also clarifies that any county prosecutor or acting county prosecutor who is enrolled in the Defined Contribution Retirement Program can obtain service credit in the Prosecutors Part, contingent upon the payment of contributions equivalent to those made during their membership in the Defined Contribution Retirement Program. Overall, this legislation aims to enhance the retirement benefits for county prosecutors by recognizing their prior judicial clerk service, which was not previously acknowledged under existing law.
