This bill amends current law to allow county prosecutors in New Jersey to receive service credit in the Prosecutors Part of the Public Employees Retirement System (PERS) for their previous work as judicial law clerks. Specifically, it permits county prosecutors, who are nominated and appointed under the New Jersey Constitution, to purchase credit for their service as law clerks to judges of the New Jersey Superior Court or justices of the New Jersey Supreme Court after their appointment as county prosecutors. This change addresses a gap in the current law, which does not recognize such purchases made after appointment.
The bill also maintains that any service credit established in PERS prior to the enactment of this bill will be recognized in the Prosecutors Part without additional costs to the prosecutor. Additionally, it stipulates that county prosecutors or acting county prosecutors enrolled in the Defined Contribution Retirement Program can also receive service credit in the Prosecutors Part, provided they pay the equivalent contributions required during their membership in that program. The bill is set to take effect immediately upon passage.
