This bill amends current law regarding penalties for trespass and vandalism on agricultural and horticultural lands in New Jersey. It specifically increases the civil penalty for individuals who knowingly or recklessly damage or injure property on such lands. Under the new provisions, if the damages exceed $10,000, the minimum civil penalty will rise from $1,000 to $2,500. This increase is in addition to any other fines, penalties, or restitution that may be applicable under existing laws.
The bill also maintains the requirement for landowners to provide conspicuous posting to prohibit trespass on their lands. The changes aim to enhance protections for agricultural and horticultural lands and respond to concerns raised at the 105th State Agricultural Convention in February 2020. The bill is set to take effect immediately upon passage.
