This bill prohibits the sale, distribution, and manufacture of chalk and crayon products that contain lead. Retailers are required to remove recalled products from display within 48 hours and return all inventory to the manufacturer or distributor within 60 business days, with the return costs borne by the manufacturer or distributor.

Penalties for violations include classifying the sale or distribution of lead-containing products as an unlawful practice under the state's consumer fraud act, which can result in monetary penalties. Retailers failing to comply with recall requirements will also face similar unlawful practice designations. Furthermore, manufacturers or distributors that do not issue recalls or properly dispose of recalled products may face escalating criminal charges, ranging from a fourth-degree crime for a first offense to a second-degree crime for repeated offenses. The bill aims to enhance consumer safety by ensuring that hazardous products are promptly removed from the market.
