This bill allows licensed outpatient substance use disorder treatment programs to offer housing to individuals receiving treatment, under specific conditions. It permits these programs to lease, manage, and own housing units while providing treatment services and transportation between the treatment site and housing. The housing must be provided under a separate contract from the treatment services, which must include a clause stating that the individual acknowledges a good faith responsibility to repay any discounts or subsidies related to the housing. Additionally, individuals must be informed that the housing and treatment services are independent of each other and can be received separately. The housing must also comply with state and local zoning and safety laws.

Furthermore, the bill maintains the prohibition against treatment programs providing or receiving any form of remuneration for referrals of individuals seeking treatment for substance use disorders, which is classified as a crime of the fourth degree. It clarifies that the provisions of the bill do not prevent individuals or programs from offering educational materials about community resources, including housing assistance. The Commissioner of Human Services is authorized to create necessary rules and regulations to implement the act, which will take effect immediately upon passage.
