This bill mandates the New Jersey Department of Environmental Protection (DEP) to create and periodically update guidelines that recommend recovered material content percentages for State and local agencies when purchasing goods made from recycled materials. The guidelines may reference those established by the United States Environmental Protection Agency, including the recommended levels outlined in the EPA's Consolidated Recovered Materials Advisory Notice. The DEP is also required to publish these guidelines as public notices in the New Jersey Register.
Furthermore, the bill stipulates that the Directors of the Division of Purchase and Property and the Division of Property Management and Construction in the Department of the Treasury, along with all relevant State and local agencies, must ensure that new procurement specifications align with the DEP's guidelines, as long as it is practical and feasible. However, this requirement does not apply to local contracting units if adhering to the guidelines would result in increased contract costs. The bill is set to take effect immediately upon enactment.
