This bill aims to legalize the possession of up to six marijuana plants for personal use, contingent upon the enactment of Assembly Bill No. 21(2R), which seeks to legalize personal use of marijuana or cannabis. While Assembly Bill No. 21(2R) has passed both Houses and is awaiting the Governor's approval, it does not allow for home cultivation of marijuana. This new legislation addresses that gap by explicitly permitting individuals to grow a limited number of plants for personal use, thereby creating a legal framework for marijuana cultivation alongside existing possession laws.
Additionally, the bill modifies existing laws regarding the possession of controlled dangerous substances, ensuring that possession of six ounces or less of marijuana, six or fewer marijuana plants, or 17 grams or less of hashish will not be classified as a crime or civil violation. It also includes provisions that the odor of marijuana cannot be used as reasonable suspicion for searches, and individuals will not lose legal rights due to marijuana possession violations. The bill further clarifies definitions related to cooperative housing, condominiums, and mobile home parks to align with the new regulations on marijuana cultivation, and it will take effect upon the enactment of Assembly Bill No. 21(2R).
