In contrast, this bill specifically permits individuals to grow up to six marijuana plants at home. The legislation also amends existing laws regarding the possession of controlled dangerous substances, stating that possession of six ounces or less of marijuana, six or fewer marijuana plants, or 17 grams or less of hashish will not be classified as a crime or civil violation.
Additionally, the bill introduces new legal language clarifying that the odor of marijuana will not constitute reasonable suspicion for searches, and individuals will not lose legal rights due to marijuana possession violations. It also revises definitions related to drug paraphernalia, ensuring that items intended for cannabis use are not automatically classified as such, and establishes that using drug paraphernalia for marijuana or hashish is not a punishable offense. Local law enforcement is mandated to report marijuana possession violations, including demographic data, to promote transparency and accountability. The act will take effect upon the enactment of Assembly, No. 21(2R) of the 2020-2021 legislative session.
