Under the new provisions, individuals will not be required to disclose expunged records related to arrests or charges that did not result in a conviction, as well as convictions for disorderly persons offenses, petty disorderly persons offenses, or violations of municipal ordinances. However, this exemption does not apply to those seeking employment as court directors, court administrators, or deputy court administrators, who must continue to disclose such records.
At the end of the five-year pilot program, the City of Paterson is mandated to submit a report to the Governor and the Legislature detailing the implementation of the program and providing recommendations regarding its continuation, modification, expansion, or termination. The intent of the pilot program is to assess whether the current expungement laws hinder qualified individuals from obtaining employment in the judicial and law enforcement sectors due to the disclosure of minor infractions or non-convictions, potentially leading to broader changes in state law based on the findings.
