The bill establishes a weigh-in-motion monitoring program in New Jersey, to be implemented by the Department of Transportation (DOT) in consultation with the Department of Law and Public Safety (DLPS). This program will utilize weigh-in-motion systems to monitor vehicle weights as they approach certain bridges, particularly those identified as being in poor condition. The DOT will determine the locations for these systems based on factors such as bridge conditions and historical violation data. The bill also mandates that records of individual vehicle and personal information collected by these systems are not to be retained or disclosed for any purposes unrelated to the program. Upon detecting violations, the DOT is required to issue a structural monitoring notification, which will lead to necessary inspections of the bridges.
Furthermore, the bill expands the authority of law enforcement officers regarding vehicle weighing and measurement, allowing them to require drivers to stop for weighing without probable cause in specific situations. For the first 90 days of the program's operation, any detected violations will result in a notice of warning rather than immediate enforcement action. Both the DOT and DLPS are tasked with publishing annual reports detailing the program's operations, including the number of vehicles weighed and violations recorded. The bill also includes provisions for the adoption of rules and regulations by both departments to ensure effective implementation and management of the monitoring program.
