This bill amends existing New Jersey law to prohibit certain non-disclosure and non-disparagement provisions in employment contracts, specifically those that waive rights or remedies related to claims of discrimination, retaliation, or harassment. The bill clarifies that such provisions are against public policy and unenforceable. Additionally, it removes a previous exemption that allowed these prohibitions to not apply to collective bargaining agreements, thereby extending the protections to all employment contracts.

Furthermore, the bill allows for mediation or arbitration clauses to be included in employment contracts that arise from collectively bargained agreements concerning claims of discrimination, retaliation, or harassment. It also mandates that any settlement agreement resolving such claims must include a notice indicating that confidentiality provisions are unenforceable if the employee publicly discloses sufficient details about the claim. The act is set to take effect immediately and will apply to all contracts and agreements entered into, renewed, modified, or amended after the effective date.
