This bill mandates that all commercial pesticide applicators utilize uniform silver flags to indicate areas where pesticides have been applied. The flags must be silver in color, of a consistent size and type, and must include information in both English and Spanish. Additionally, these flags are required to remain in place for a minimum of 72 hours following the pesticide application.
Furthermore, the bill prohibits the use of silver flags in any manner that could be confused with pesticide applications, such as for marking invisible dog fences or underground utilities. The Department of Environmental Protection is tasked with developing rules and regulations to implement these provisions. The act is set to take effect one year after its enactment, although the Commissioner of Environmental Protection may take necessary administrative actions prior to that date.
