This bill mandates that limited liability companies (LLCs) and foreign limited liability companies that are grantees of deeds for residential real property, specifically those containing one or two dwelling units or multiple dwellings, must disclose their registered agent's information when submitting the deed for recording. An affidavit identifying the registered agent, as well as at least one member of the company if the registered agent is not a member, must be appended to the deed. This requirement aims to enhance transparency regarding ownership and accountability in rental properties.
Additionally, the bill allows municipalities to enact ordinances that enable charges issued to these LLCs or foreign LLCs under housing, building, or health codes to become liens on the property if unpaid after a specified period. Specifically, if a charge remains unpaid for thirteen months, it can be converted into a municipal lien, provided that the property owner is given prior notice. This provision is intended to ensure that municipalities can effectively enforce compliance with local codes and recover unpaid charges related to residential properties.
