This bill mandates that individuals who are not licensed by the New Jersey Real Estate Commission and who use text messaging to solicit homeowners regarding the sale of a home must first send a separate text message to the homeowner. This message must inform the homeowner that the sender is not a licensee of the commission, provide the name of the sender's employer, and clearly state that the text is a solicitation. Violators of this requirement will face penalties of up to $5,000 for the first offense and up to $10,000 for subsequent offenses, with enforcement handled by the Division of Consumer Affairs in the Department of Law and Public Safety.
Additionally, the bill requires the Division of Consumer Affairs to create a public education program and marketing campaign aimed at informing both licensed individuals and homeowners about the new provisions. This program may also address issues related to fraudulent text message solicitations from unlicensed individuals and provide resources to help homeowners verify the licensing status of real estate professionals. The bill is set to take effect seven months after its enactment, although the division and commission may take preparatory actions beforehand.
