This bill amends existing legislation regarding the use of child passenger restraint systems in motor vehicles by increasing the penalties for violations. The current fine of $50 to $75 for failing to secure a child in a restraint system is replaced with a new structure: a $100 fine for a first offense, while second or subsequent offenses will incur fines ranging from $250 to $500. Additionally, the bill allows for the waiver of the fine for a first offense if the defendant can prove possession of a child passenger restraint system.
Furthermore, the bill establishes the Division of Highway Traffic Safety Child Passenger Restraint System Assistance Fund, which will be managed by the State Treasurer. A portion of the fines collected—specifically, $25 from each violation—will be allocated to this fund, which is designated for purchasing child passenger restraint systems for distribution to organizations that run lending programs. This initiative aims to enhance child safety in vehicles by ensuring access to proper restraint systems.
