This bill amends existing legislation concerning the use of child passenger restraint systems in motor vehicles by increasing the penalties for violations. The current fine of $50 to $75 for failing to secure a child in a restraint system is replaced with a new structure: a $100 fine for a first offense, while second or subsequent offenses will incur fines ranging from $250 to $500. Additionally, the bill allows for the waiver of the fine for a first offense if the defendant can prove possession of a child passenger restraint system.

Furthermore, the bill establishes a nonlapsing revolving fund known as the Division of Highway Traffic Safety Child Passenger Restraint System Assistance Fund, which will be administered by the State Treasurer. A portion of the fines collected—specifically, $25 from each violation—will be deposited into this fund. The funds will be used exclusively to purchase child passenger restraint systems for distribution to individuals and organizations that run lending programs for these systems. The bill aims to enhance child safety in vehicles while also providing resources for those in need of restraint systems.
