The New Jersey COVID-19 Related Business Immunity Act establishes legal immunity for businesses against civil liability claims related to COVID-19 exposure on their premises or during activities they manage. This immunity is intended to protect employers, which include a wide range of entities such as individuals, partnerships, corporations, and organized groups, from lawsuits arising from individuals who may claim to have been exposed to the virus while on the business's property. The immunity provided by this act is in addition to any existing protections under state or federal law.
However, the immunity does not extend to cases of willful misconduct, reckless infliction of harm, or intentional infliction of harm. The bill aims to support economic recovery by alleviating the fear of costly legal actions against businesses due to COVID-19 exposure, thereby encouraging their operation and patronage. The act is set to take effect immediately upon passage.
