The bill amends Section 38 of P.L.1974, c.119 (C.9:6-8.58) to enhance the provision for therapeutic services for individuals found to have abused or neglected a child. It allows the court to order these individuals to accept therapeutic services or evaluations, which may include homemaker services, functional education, group self-help programs, and professional therapy. Importantly, the bill stipulates that no individual can be committed to a residential mental health facility without their consent or following a specific hearing process. Additionally, the court is tasked with determining the individual's ability to pay for these services.

Furthermore, the bill addresses individuals with developmental disabilities who are eligible for services from the Division of Developmental Disabilities. It mandates that the Division of Child Protection and Permanency consult with the Division of Developmental Disabilities to create a tailored service plan that considers the individual's disability. The Division of Developmental Disabilities is also responsible for determining the appropriate method to provide these services. The act is set to take effect 90 days after its enactment.
