This bill introduces a new section to New Hampshire law, specifically RSA 4, allowing the governor to declare a state of emergency if the legislature fails to pass a budget or a continuing resolution by July 1 of the first year of a biennium. The new section, 4:45-a, stipulates that the governor can declare this state of emergency not only for budget failures but also in the event of a veto of the budget. The emergency declaration will last for 60 days but can be renewed for an additional 60 days up to three times with majority approval from both legislative houses.

During the declared state of emergency, various essential services and positions will be fully funded at the previous fiscal year's levels. This includes funding for the legislative and judicial branches, public safety services, corrections, transportation, health and human services, and other critical departments. The bill aims to ensure that vital state functions continue uninterrupted in the event of budgetary delays or vetoes, thereby maintaining essential services for New Hampshire residents. The act will take effect 60 days after its passage.
