This bill amends existing laws regarding the expansion of dwellings over water, allowing for modifications to the exterior of such structures under specific conditions. The new legal language permits the addition or expansion of legally existing exterior features, such as decks and balconies, without increasing the interior floor space or changing the use from recreational to residential or commercial. The cumulative area of these modifications is limited to 100 square feet for properties with 100 linear feet or less of shoreline frontage, and one square foot per linear foot of shoreline for larger properties. Additionally, any modifications must not penetrate the water or bank and require approval from the Department of Environmental Services, which will also set the associated fees.

The bill also introduces a fee structure for these modifications, with revenues directed to the water resources fund. The commissioner is tasked with adopting rules for the approval process and fee calculations within 120 days of the bill's effective date. The existing restrictions on the footprint and dimensions of structures remain in place, except as specified in the new provisions. The bill is expected to have a minimal fiscal impact, estimated at less than $10,000 for each fiscal year from 2027 to 2029.
