The proposed bill, known as the Honesty and Transparency in Education Act, mandates that all educators credentialed by the New Hampshire Department of Education must respond honestly and completely to written inquiries from parents and legal guardians regarding information about their children enrolled in the educator's school. The bill introduces a new section, RSA 189:13-d, which requires responses to be provided within 10 business days of receipt. However, if a credential holder believes that providing a complete response could put the student at imminent risk of physical harm, abuse, or neglect, they are required to report this to the Department of Health and Human Services within 48 hours and may withhold only the information that poses the risk.
Additionally, the bill stipulates that the state board of education must adopt rules by June 30, 2027, to amend the code of ethics and conduct for educators in relation to this new requirement. Violations of this section will be treated as breaches of the code of conduct for New Hampshire educators and will be subject to investigation. The act is set to take effect on January 1, 2027.
