The "DMV e-Signature Act" authorizes the director of the division of motor vehicles to implement rules regarding the acceptance of electronic signatures on various records, documents, applications, and forms. Specifically, the bill amends RSA 260:5 to require the director to accept electronic signatures as defined in RSA 294-E:2, VIII, on prescribed records and documents. Additionally, it introduces a new section, RSA 259:100-aa, defining "signature" to include both written and electronic signatures authorized by the director.

Furthermore, the bill modifies RSA 261:22, II-b to state that supporting documents used to transfer vehicle ownership to an insurer after payment of damages will no longer require notarized signatures. These documents can be signed electronically and printed on hard copy, which includes forms such as limited power of attorney, duplicate title, and odometer statements. The bill also includes a provision requiring applicants to indemnify the department from any liability arising from errors or misrepresentations in their submissions related to these electronic signatures. The act is set to take effect 60 days after its passage.
