This bill mandates that all contracting and investment decisions made by executive branch agencies in New Hampshire must be focused exclusively on providing direct benefits, services, or goods to the state's citizens. It introduces a new section, RSA 21-I:11-f, which stipulates that agencies cannot award or renew contracts or make investments unless the primary purpose is to benefit New Hampshire citizens. The bill also emphasizes that agencies should not consider any interests or objectives that do not align with this primary purpose. However, it allows for compliance with federal law and conditions for federal funding, as well as participation in programs that benefit New Hampshire citizens.
Additionally, the bill requires that all contracts entered into by executive branch agencies include a certification confirming adherence to these requirements. The director of procurement and support services is tasked with developing a standard certification and may issue further rules and guidance for implementation. The bill also includes a severability clause, ensuring that if any part of the act is deemed invalid, the remaining valid parts will still be in effect. The act is set to take effect 60 days after its passage and is projected to have a minimal fiscal impact of less than $10,000 for each fiscal year from 2026 to 2029.
