This bill amends the calculation of "average final compensation" for members of the group II retirement system, specifically targeting police and fire personnel who began their service before July 1, 2011, and were not vested by January 1, 2012. The new legal language modifies the existing definition in RSA 100-A:1, XVIII(c)(1) to allow for the inclusion of average annual compensation for extra and special duty pay during the member's highest five years of creditable service. The bill stipulates that this inclusion shall not exceed the average annual amount of such compensation paid to the member over their last five years of service on or after January 1, 2012, or over all years of creditable service on or after that date if the member has less than five years of service.
Additionally, the bill removes the previous limitation that restricted the average percentage of compensation paid in excess of the full base rate during the highest five years to not exceed the average percentage over all years of service after January 1, 2012. This change aims to align the calculation method with the formula established in HB 2 (2025) and is set to take effect 60 days after its passage.
