This bill mandates that physicians disclose any financial compensation exceeding $5,000 received from a preferential promotion before prescribing treatments related to that promotion. The term "preferential promotion" is defined as any financial arrangement intended to influence the recommendation or use of specific medical products or services. The bill outlines that "compensation" includes various forms of financial incentives such as payments, gifts, and travel expenses. It also establishes the concept of "informed consent," which requires patients to be fully informed about the risks and benefits of medical interventions.
Under the new legal framework, physicians must provide written disclosure as part of the informed consent process, detailing the name of the entity providing the compensation, the nature and amount of the compensation, a statement regarding potential conflicts of interest, and an affirmation of the physician's independent clinical judgment. This new requirement is inserted into RSA 329 as sections 54 and 55, while the effective date for the implementation of this act is set for January 1, 2027.
