This bill introduces new employment protections for members of the general court, specifically targeting employers with 25 or more employees. It amends RSA 275 by adding a new subdivision, which outlines the rights of general court members to leave work to attend voting sessions. Under the new provisions, employers are required to allow these employees to take time off for voting without the necessity of having accrued paid time off. However, employees must provide their employers with notice of their attendance at general court sessions in a timely manner. Employers are prohibited from discharging employees for attending these sessions, although they may require the use of accrued leave or grant unpaid time off if no paid time is available.
Additionally, the bill establishes enforcement mechanisms, granting the labor commissioner the authority to impose civil penalties on employers who violate these provisions. The penalties will be assessed in accordance with existing procedures outlined in RSA 273:11-a, and employers have the right to appeal any penalties imposed. The new employment protections will take effect 60 days after the bill's passage.
