This bill introduces a new section to RSA 540-A, specifically addressing the responsibilities for snow and ice removal in residential lease agreements. It mandates that the lease must explicitly state who is responsible for snow and ice removal. If the lease does not specify otherwise, the property owner or landlord will be responsible for maintaining safe access and clearing snow and ice from common areas, such as driveways, walkways, and entryways used by multiple tenants. Additionally, landlords and tenants can agree in writing for the tenant to take on these responsibilities, provided that the agreement is clear, voluntary, and included in the lease.
The bill also clarifies that local ordinances imposing additional duties on property owners or occupants regarding public sidewalks or rights of way remain unaffected by this new section. The provisions of this act will apply to all residential leases that are entered into or renewed on or after its effective date, which is set for January 1, 2027.
