This bill establishes restrictions on the sale of certain high-risk rodenticides in New Hampshire, specifically targeting products containing active ingredients such as brodifacoum, bromadiolone, and warfarin, among others. It mandates that no person may distribute or sell these rodenticides without first verifying the purchaser's status as either a certified applicator or a registered private or commercial agricultural operation. Verification must be documented at the point of sale, and records must be maintained for a minimum of three years. Additionally, the bill prohibits the sale of these products through online marketplaces unless the seller verifies the purchaser's license or registration status.
The bill also grants enforcement authority to the Department of Agriculture, Markets, and Food, as well as state police and other law enforcement agencies, to investigate and penalize violations, which may include unlawful internet or cross-border sales. Violators may face civil penalties of up to $5,000 per violation, with each day of continued violation constituting a separate offense. The act is set to take effect on January 1, 2027.
