This bill introduces a new chapter, Chapter 125-T, to the existing law that restricts the use of coal tar-based sealant products containing high levels of polycyclic aromatic hydrocarbons (PAHs). Specifically, it defines "coal tar" as a substance with PAH levels exceeding 10,000 milligrams per kilogram and outlines what constitutes a "coal tar sealant product." The bill prohibits the sale and application of such sealant products on driveways or parking areas starting January 1, 2027.

Additionally, the bill allows for exemptions from these prohibitions if a person submits a written request to the commissioner of the Department of Environmental Services, detailing the need for the exemption, particularly for research or development of alternative technologies. The legislation is expected to have a minimal fiscal impact of less than $10,000 for each fiscal year from 2027 to 2029.
