This bill amends the definition of the practice of pharmacy under RSA 318, allowing pharmacists to prescribe certain prescription devices necessary for the delivery or administration of prescribed drugs. The updated definition of "practice of pharmacy" now includes the authority for pharmacists to prescribe specific devices as outlined in the new section RSA 318:47-n. Additionally, the term "prescription device" is clarified to include items restricted for sale or distribution only upon the order of a licensed practitioner, with specific devices listed in the new section.

The new section, RSA 318:47-n, specifies that pharmacists may prescribe and dispense various FDA-approved prescription devices, including inhalation spacers, nebulizers, CPAP machine supplies, diabetes testing supplies, and syringes. Pharmacists must adhere to established standards for competent pharmacy practice and are required to notify the prescribing practitioner or the patient's primary care provider about the prescribed device, although this notification is not mandatory before dispensing. The bill also mandates the board of pharmacy to collaborate with the boards of medicine and nursing to implement the new regulations. The act will take effect 60 days after its passage.
