This bill amends RSA 208:8 to clarify the regulations surrounding the use of lights while hunting or engaging in outdoor activities at night. It establishes that a person is guilty of a misdemeanor if they knowingly take wild birds or animals between 1/2 hour after sunset and 1/2 hour before sunrise, except as authorized by New Hampshire fish and game rules. The bill also specifies that using artificial light during these hours to locate wildlife is prohibited if the person possesses certain firearms or hunting equipment. However, it introduces new provisions stating that the operation of a motor vehicle using fixed forward-facing lights in a normal driving manner will not be considered a violation, nor will the incidental use of certain lights during typical vehicular maneuvers.
Additionally, the bill outlines exceptions to the prohibition on using lights for individuals engaged in legitimate agricultural activities, utility or forestry work, or those lawfully present on property with permission, provided they are not hunting or harassing wildlife. The previous presumption of knowledge regarding illegal night hunting has been removed, and the bill includes a provision that any person convicted of illegal night hunting will forfeit any equipment used during the offense. The act is set to take effect on January 1, 2027.
