This bill establishes new requirements for the closure and remediation of abandoned or leaking on-premises-use fuel oil tanks, as well as mandates disclosure of tank status during property sales. It introduces a new subdivision to RSA 146-A, defining key terms such as "On-Premises-Use Fuel Oil Tanks," "Abandoned," "Oil tank service company," and "Discharge." The bill outlines specific closure requirements for tanks located beneath structures, which include retaining a certified oil tank removal company to collect soil samples and remediating any detected discharges. For tanks located outside structures, the bill mandates their removal within 180 days of abandonment.
Additionally, the bill requires sellers of residential properties with on-premises-use fuel oil tanks to disclose the presence and status of these tanks to potential buyers, along with providing test results of soil samples taken around the tanks. The Department of Environmental Services is tasked with adopting rules to implement these provisions, including standards for soil sampling, remediation, and tank closure. The act is set to take effect 60 days after its passage.
