This bill mandates that certain commercial drivers and drayage truck operators be granted access to restroom facilities under specific conditions. It introduces a new subdivision to RSA 155, titled "Restroom Access for Drivers," which defines key terms such as "covered driver," "covered establishment," and "covered restroom facility." A "covered driver" is defined as any commercial driver, while a "covered establishment" refers to businesses open to the public for goods or services, excluding smaller establishments with employee-only restrooms. The bill stipulates that covered drivers must be allowed access to restroom facilities at covered establishments when delivering or waiting to load goods, without requiring any physical modifications to existing restrooms.
Additionally, the bill outlines provisions for covered drayage truck operators, who are defined as drivers of heavy vehicles operating in port or intermodal rail yard areas. Terminal operators are required to provide adequate restroom facilities for these operators, ensuring access to existing restrooms and potentially adding more where necessary. The bill emphasizes that restroom access should not pose safety risks to either the truck operators or terminal employees. The act will take effect 60 days after its passage.
