This bill amends RSA 275:43-a to exclude certain employees from reporting-time payment requirements, specifically those who work remotely. The new language specifies that employees who report in person to their employer's physical location at the employer's request must be paid a minimum of 2 hours at their regular rate. However, this requirement does not apply to employees of counties or municipalities, ski and snowboard instructional employees at ski resorts (provided they receive equivalent compensation), and employees who work remotely outside of the employer's physical location. It is also clarified that the requirement to pay wages to remote employees remains intact as per RSA 275:43.
Additionally, the bill states that employers who make a good faith effort to notify an employee not to report to work will not be liable for wages under this section. If an employee does report to work after unsuccessful notification attempts or if the employer is unable to notify them for any reason, the employee is expected to perform any assigned duties upon arrival. The act is set to take effect 60 days after its passage.
