This bill amends the existing workers' compensation law to establish a prima facie presumption that acute stress disorder and post-traumatic stress disorder (PTSD) in emergency responders are occupationally caused. Specifically, it modifies RSA 281-A:17-c by inserting new language that clarifies this presumption applies notwithstanding certain provisions in RSA 281-A:2, XI and XIII, and RSA 281-A:27, while deleting the reference to RSA 281-A:16. This change aims to facilitate the claims process for emergency responders suffering from these mental health conditions.

Additionally, the bill specifies that the "date of injury" for claims related to acute stress disorder and PTSD will be determined according to the provisions for occupational disease or cumulative trauma as outlined in RSA 281-A:16. This insertion provides a clear framework for establishing the timeline of injury, which is crucial for processing workers' compensation claims. The act is set to take effect 60 days after its passage, with an effective date of August 9, 2025.
