This bill modifies the conditions under which municipalities can issue building or occupancy permits for properties adjacent to class VI roadways. Specifically, it repeals and reenacts RSA 674:41, I(c), which previously restricted such permits. The new legal language stipulates that applicants must sign a liability waiver acknowledging that the municipality will not maintain the class VI highway or provide services to any lot accessible by it. Additionally, the municipality will not be responsible for any losses or damages resulting from the lack of services, and the applicant will bear full responsibility for these services.
Furthermore, the bill requires that, before a building permit is issued, the applicant must provide evidence that the signed waiver has been recorded in the county register of deeds and demonstrate that the lot and any buildings on it are insurable. The act is set to take effect on July 1, 2026.
