This bill amends the existing regulations regarding the construction of buildings on lots adjacent to class VI roadways. Specifically, it repeals and reenacts RSA 674:41, I(c), which previously outlined the conditions under which building permits could be denied for such properties. The new legal language stipulates that municipalities cannot deny building or occupancy permits for properties adjacent to class VI roads if the applicant meets certain conditions. These conditions include signing a liability waiver that acknowledges the municipality's lack of responsibility for maintaining the highway or providing services, as well as the applicant's sole responsibility for any related services.

Additionally, the applicant must provide evidence that the liability waiver has been recorded in the county register of deeds and demonstrate that the lot and any buildings on it are insurable before a building permit can be issued. The bill is set to take effect on July 1, 2026.
