This bill amends existing condominium law to clarify the status of condominium rules and bylaws when they are registered with the registry of deeds. Specifically, it states that if a condominium chooses to register its rules or bylaws, these documents will be considered an integral part of the condominium instruments. Additionally, the bill removes the term "bylaws" from the definition of "condominium instruments" and establishes that the original condominium declaration can only be amended by a vote of at least 51 percent of unit owners after all units have been sold and control has passed to them.
Furthermore, the bill introduces a new section that allows the condominium board to register the rules of the unit owners' association with the county registry of deeds, granting these rules the force of law until they are rescinded by a vote of the unit owners. The bylaws can still be amended by a simple majority of those present at a properly noticed meeting. The changes aim to enhance the governance of condominiums and ensure that unit owners have a clear process for amending key documents. The act will take effect 60 days after its passage.
