This bill amends existing condominium law to clarify the status of condominium rules and bylaws. Specifically, it states that if a condominium registers its rules or bylaws with the registry of deeds, these documents will be considered an integral part of the condominium instruments. Additionally, the bill removes the term "bylaws" from the definition of "condominium instruments" and establishes that once all units are sold and control is transferred to the unit owners, the original declaration can only be amended by a vote of at least 51 percent of the unit owners. Bylaws can still be changed by a simple majority of those present at a properly noticed meeting.
Furthermore, the bill introduces a new section that allows the condominium board to register the rules of the unit owners' association with the county registry of deeds, granting these rules the force of law until they are rescinded by a vote of the unit owners. This change aims to enhance the governance of condominiums by ensuring that registered rules and bylaws are formally recognized and enforceable. The act will take effect 60 days after its passage.
