This bill introduces new regulations regarding tip pooling and sharing arrangements, as well as automatic service charges. It amends RSA 279:26-b to require employers who administer tip pooling or sharing to document their practices, including providing an example of the arrangement. Additionally, employers must give written notice to employees about the current tip pooling or sharing arrangement, which must include a statement that participation is voluntary and that employees can choose which staff to share tips with, as well as the option to opt out on any shift.

Furthermore, the bill adds a new section, RSA 279:26-c, which defines "automatic service charge" and mandates that employers who apply such charges must disclose the allocation of these charges on itemized receipts provided to customers. Specifically, the receipt must indicate the percentage of the service charge that goes directly to the employees serving the customer, and if any portion does not go to the employees, the receipt must clarify the purpose of that allocation. The act will take effect 60 days after its passage.
