This bill amends current law to prohibit the division of motor vehicles from suspending a person's driver's license or driving privileges due to unpaid debts related to the towing or storage of a vehicle by a commercial entity. Specifically, it introduces a new section, RSA 263:56-h, which states that the director cannot suspend, revoke, or fail to renew a driver's license for failure to pay removal and storage fees. Additionally, individuals whose licenses have been suspended for such debts will have their licenses reinstated without a reinstatement fee, and they will be eligible for renewal without incurring additional costs.
The bill also makes amendments to RSA 263:57, changing the jurisdiction from "a district or municipal court" to "the circuit court" for license suspension cases. It further clarifies that a hearing must provide reasonable notice of the possibility of license suspension prior to the hearing. The act is set to take effect 60 days after its passage and is expected to have a minimal fiscal impact of less than $10,000 in each fiscal year from 2025 to 2028.
