This bill grants municipalities the authority to regulate the construction, deployment, and operation of 5G wireless facilities within their jurisdictions. Specifically, it repeals the existing chapter on personal wireless service facilities and establishes a new chapter (12-K) that allows municipalities to deny the construction of 5G towers. Municipalities exercising this authority must provide a detailed written decision outlining the reasons for the denial, which may include public health, safety, environmental impacts, and local zoning considerations. The decision must comply with state and federal laws and be based on substantial evidence.

Additionally, the bill allows municipalities to create local regulations and procedures to enforce these provisions, ensuring they align with state and federal law. It also provides applicants who are denied the opportunity to appeal the municipality's decision according to established procedures. The act will take effect 60 days after its passage and is projected to have a minimal fiscal impact of less than $10,000 in each fiscal year from 2025 to 2028.
