This bill amends RSA 215-A by adding a new section, 215-A:6-a, which allows municipalities to designate parts of state and local highways for all-terrain vehicle (ATV) use. The governing body of a municipality can make these designations as long as they do not restrict the use of other vehicles permitted by law. The bill exempts municipalities and the bureau of trails from certain permitting processes related to bridges or connectors on designated highways. It also establishes that designated portions of highways will have a maximum speed limit of 40 miles per hour, and operators of ATVs must hold a valid driver's license and comply with traffic laws applicable to motor vehicles.
Additionally, the bill requires that ATVs operating on designated highways be equipped with specific safety features, including directional signals, emergency flashers, and a horn. Municipalities are responsible for the installation and maintenance of signage indicating ATV use on these highways, and they must provide maps and descriptions of designated areas. The bill also mandates that various state departments adopt rules to ensure the safety of all motorists and facilitate ATV transportation on these designated portions. The act is set to take effect on January 1, 2026.
