This bill amends current law to allow municipalities to designate sections of state and local highways, including bridges and road connectors, for all-terrain vehicle (ATV) use. The new section, 215-A:6-a, specifies that municipalities can make these designations without restricting the use of other vehicles permitted by law. It also exempts municipalities and the bureau of trails from certain permitting processes related to bridges or connectors designated for ATV travel. The bill establishes a maximum speed limit of 40 miles per hour for ATVs on these designated portions and requires operators to hold a valid driver's license and comply with traffic laws applicable to motor vehicles.
Additionally, the bill mandates that ATVs on designated highways be equipped with specific safety features, including directional signals, emergency flashers, and a horn. Municipalities are responsible for the installation and maintenance of signage indicating ATV use on these highways and must provide maps and descriptions of designated areas. The bill also requires various state departments to adopt rules to ensure the safety of all motorists on these designated highways. The act is set to take effect on January 1, 2026.
