This bill amends existing laws regarding the use of special education funding by explicitly prohibiting the expenditure of state aid funds and differentiated aid special education funds on students who are not receiving special education services. The new legal language inserted into RSA 186-C:18 and RSA 198:42 clarifies that funds distributed under these sections must be used solely for students receiving special education services. It also allows for the incidental provision of special education curricula or pedagogy to non-special education students only when necessary for compliance with applicable laws or rules, and mandates that reasonable efforts be made to minimize such incidental provisions.

The bill aims to ensure that special education resources are allocated appropriately and effectively, thereby preventing misuse of funds intended for special education. The provisions will take effect on July 1, 2025, giving schools and municipalities time to adjust their funding practices in accordance with the new regulations.
