This bill amends RSA 612:2 regarding the duty of the governor in extradition cases. It establishes that while the governor is generally required to arrest and extradite individuals charged with crimes in other states, there are exceptions. Specifically, the governor is not obligated to extradite individuals if the charges are based solely on allegations that are deemed to represent constitutionally protected activities, as determined by the United States Supreme Court, the New Hampshire Supreme Court, or through a majority vote of the New Hampshire House of Representatives, or by a declaration from the governor.

Additionally, the bill introduces a mechanism for individuals who believe they are being politically persecuted or maliciously prosecuted to petition the governor and the House of Representatives for a declaration of their status. If such a declaration is made, the individual would be protected from extradition by New Hampshire authorities. The bill also specifies that it will take effect on January 1, 2026.
