SB 516-FN, also known as "The New Hampshire Right to Work Act," prohibits collective bargaining agreements that require employees to join a labor union. It guarantees the right of individuals to form, join, or assist labor organizations, or to refrain from doing so, without fear of penalty or reprise. The bill also prohibits employers from deducting any dues, fees, assessments, or other charges from employee wages without the employee's signed written authorization. Any agreement or practice that violates the rights of employees as guaranteed by this chapter is declared unlawful. The bill also prohibits coercion, intimidation, or discrimination against employees based on their support or nonsupport of a labor organization. Violators may face fines, imprisonment, or both. The bill provides for civil remedies and assigns the duty of investigating and prosecuting violations to the attorney general. The provisions of this bill apply to contracts entered into on or after the effective date, but do not apply to certain federal employers and employees or where they conflict with or are preempted by federal law.
