This bill, known as the Protection of Women's Sports Act, mandates that all school sports teams, whether interscholastic or intercollegiate, must be explicitly categorized based on the biological sex at birth of the athletes as male, female, or coeducational. It prohibits biologically male students, as determined by the sex listed on their official birth certificate, from participating in sports teams or events designated for females and from entering female locker rooms. The bill exempts sports in grades K-5 and intramural or club sports from these requirements.
The bill also establishes a cause of action for athletes who experience direct or indirect harm due to a violation of these requirements, allowing them to seek injunctive relief and other equitable remedies against the responsible educational institution. Additionally, athletes who face retaliation for reporting violations are similarly protected and can seek legal recourse. Prevailing parties in such actions are entitled to reasonable attorney’s fees and costs. However, no governmental entity or educational institution will be liable to any athlete for complying with the requirements of this act. The act is set to take effect on July 1, 2024.
