This bill establishes the position of assistant commissioner within the Department of Agriculture, Markets, and Food. The bill amends RSA 425:3, III by removing the provision that allowed the commissioner to appoint a staff member to act in their stead during absences. Instead, it inserts new language that requires the commissioner of Agriculture, Markets, and Food to nominate an assistant commissioner, who will be appointed by the governor with the consent of the council and will serve at the pleasure of the commissioner.

The assistant commissioner's role is to perform duties assigned by the commissioner and to assume the commissioner's duties if they are unable to perform them for any reason. Additionally, the bill amends RSA 94:1-a, I(b) to include the salary specification for the assistant commissioner position.
