This bill amends current law regarding the seizure, custody, and disposition of property collected during a police investigation. The bill provides for the automatic return of seized property to its rightful owner within 5 days if all charges in a criminal case result in a verdict of not guilty or are dismissed prior to verdict. However, the police shall not return any firearm to a person who is prohibited by law from possessing a firearm. The bill also allows the state to object to the return of the property, in which case the court will allow the property owner an opportunity to respond. If the court upholds the state's objection, the state must either petition the court to further extend the time to return the property or return the property. The bill also includes provisions for the disposition of other seized property and specifies that any property subject to forfeiture and disposition under other laws shall be disposed of accordingly. The bill takes effect on January 1, 2025.
