The bill pertains to the process of conducting background checks on individuals associated with applicants for solid waste facility permits. It amends RSA 149-M:9, III(a) to expand the scope of individuals subject to background checks. Previously, the law required a performance history of the applicant and its officers and directors. The new amendment includes partners and individuals or entities with managerial, supervisory, or substantial decision-making authority and responsibility for the management of operations or activities for which a permit is being sought.

The bill authorizes the department of environmental services to request the attorney general to conduct a background investigation on the expanded list of individuals associated with the permit applicant. This investigation will include both the performance history and criminal record. The cost of the investigation is to be borne by the applicant. Additionally, the applicant must demonstrate that the proposed facility provides a substantial public benefit. The act was approved on June 14, 2024, and will take effect on August 13, 2024.
